Terms of Service

These Terms of Service ("Terms") govern your access to and use of Habit Coach, the mobile application and related services (the "Service") operated by Velnix Inc. ("Velnix", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide when creating an account is accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Tell us immediately if you suspect unauthorized use. You can delete your account at any time from within the app; this permanently removes your profile, habits, plans, and coach history.

3. Description of the Service

Habit Coach helps you plan your day and build habits using AI-assisted scheduling and coaching. Plans, suggestions, and chat responses are generated automatically based on the information you provide and may be incomplete, inaccurate, or unsuitable for your specific situation.

Habit Coach is not a medical, mental health, financial, or other licensed professional service. Nothing in the app is medical or psychological advice, diagnosis, or treatment. If you are experiencing a medical or mental health emergency, contact emergency services or a qualified professional directly rather than relying on the app.

4. Subscriptions and Billing

Some features require a paid subscription, purchased through the Apple App Store or Google Play. Pricing, billing cycle, free trial terms (where offered), renewal, and cancellation are handled by Apple or Google under their own terms — manage or cancel your subscription from your App Store or Play Store account settings. Unless a trial is canceled before it ends, it converts automatically into a paid subscription. Refunds are handled according to Apple's or Google's refund policies, not directly by us.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to reverse engineer, decompile, or extract the source code of the app, except where the law expressly permits it;
• Interfere with or disrupt the Service, or attempt to access it through automated means (scraping, bots) without our consent;
• Use the AI coach to generate or request illegal, harassing, or abusive content.

6. Your Content

You retain ownership of the habits, tasks, notes, and messages you enter into the Service ("your content"). You grant us a limited license to use, store, and process your content solely to operate, maintain, and improve the Service, including generating your plans and coaching responses. You are responsible for the content you submit.

7. Third-Party Services

The Service relies on third parties to operate — including Supabase for authentication and data storage, Google for AI-generated plans, and RevenueCat together with Apple and Google for subscription billing. We are not responsible for outages, errors, or changes made by these providers.

8. Intellectual Property

The Service, including its design, software, and branding, is owned by Velnix Inc. or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or misuse the Service. You may stop using the Service and delete your account at any time.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated plans and coaching will be accurate or suitable for your needs.

11. Limitation of Liability

To the maximum extent permitted by law, Velnix Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose.

12. Governing Law

These Terms are governed by the laws of [governing jurisdiction], without regard to its conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after a change takes effect means you accept the updated Terms.
